Everlane Realty respects the intellectual-property rights of others and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. If you believe material on this site infringes a copyright you own or control, you can send a written notice to our designated agent using the information below.

How to file a takedown notice
To be effective under §512, a written notice of claimed infringement should include all of the following:
- Your physical or electronic signature (as the copyright owner, or a person authorized to act on the owner’s behalf);
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material you claim is infringing, with enough detail (such as the page URL) for us to locate it;
- Your contact information — name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
On receiving a valid notice, we will act on it as required by §512, which may include removing or disabling access to the material.
Counter-notification
If your material was removed or disabled and you believe that was a mistake or a misidentification, you may send our designated agent a written counter-notification that includes:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and the location where it appeared before removal;
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification;
- Your name, address, and telephone number, a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the party who filed the original notice or that party’s agent.
Repeat infringers
In appropriate circumstances, we may disable or terminate access for users who are found to be repeat infringers.
MLS/IDX copyright notice
Because this site displays property-listing content from Stellar MLS distributed by MLS GRID, the following two paragraphs are published as required by the MLS GRID IDX Rules (Rule 30, “Required DMCA Notice”):
The Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any content or material made available in connection with our website or services infringes your copyright, you (or your agent) may send us a notice requesting that the content or material be removed, or access to it blocked. Notices must be sent in writing by email to: serge@everlanerealty.com.
“The DMCA requires that your notice of alleged copyright infringement include the following information: (1) description of the copyrighted work that is the subject of claimed infringement; (2) description of the alleged infringing content and information sufficient to permit us to locate the content; (3) contact information for you, including your address, telephone number and email address; (4) a statement by you that you have a good faith belief that the content in the manner complained of is not authorized by the copyright owner, or its agent, or by the operation of any law; (5) a statement by you, signed under penalty of perjury, that the information in the notification is accurate and that you have the authority to enforce the copyrights that are claimed to be infringed; and (6) a physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf. Failure to include all of the above information may result in the delay of the processing of your complaint.”
Operations duty: any DMCA notice we receive concerning MLS listing content must be forwarded to DMCAnotice@MLSGrid.com within 24 hours of receipt (per Rule 30) — tracked in the feed operations runbook.
